Style Trumps Profit 2 to 1 for Homeowners Nationwide | Clean Slate

Even as new and existing home sales and prices climb, homeowners are prioritizing lifestyle over ROI, according to a recent Houzz & Home Survey conducted among users of the Houzz app and website. Houzz is a visual and social platform for home design and remodeling, with more than seven million unique users of the site and iPad app each month, 89% of which are homeowners.

The survey of nearly 30,000 Houzz users nationwide found that homeowner priorities when it comes to remodeling and decorating are focused on improving their own quality of life rather than how to turn a profit from the next buyer.

Among homeowners planning to build, remodel or decorate in the next two years, 86 percent cited ?improving the look and feel of the space? as an important driver for remodeling projects, while only 47 percent cited ?increasing home value.? The gap between these priorities was consistent across all income levels and demographic groups.

In the next two years, 72 percent of homeowners surveyed plan to decorate or redecorate, 40 percent plan to remodel or construct an addition, 15 percent plan to purchase and move into a new home, while another 10 percent are planning to build a custom home.

Custom homes are particularly popular in the Southern U.S. Top cities for custom home builds are Jackson, Mississippi where 21 percent of homeowners surveyed are building the home of their dreams from scratch, and Houston, TX and Little Rock, AR, which both reported 18 percent of homeowners planning to build new.

Kitchens and bathrooms are the most popular remodeling projects among Houzz users, with 48 percent of respondents planning a bathroom remodel, and 45 percent redoing a kitchen in the next two years. Midwesterners have the highest budgets for kitchen and bath remodels at $30,500 and $13,600 respectively, while the South is allocating the least at $23,800 and $11,600.

57 percent of Houzz homeowners planning to complete a project in the next two years will hire a general contractor, 35 percent a kitchen or bath professional and 32 percent will hire a carpet or flooring professional.? Thirty percent are planning to hire an architect, 26 percent an interior designer and 24 percent a landscape architect or designer.

About half ? 52 percent ? say they will save money by completing some projects themselves.

In fact, even upscale homeowners are taking a hands-on approach to building, remodeling and decorating projects. The survey found that while 45 percent of homeowners at upper income levels ($150,000+) are choosing to hire an architect, interior designer, general contractor or another remodeling or decorating professional to complete a project in its entirety, an equal number of them are combining professional help and DIY efforts, a proportion only slightly smaller than the 49 percent taking this combination approach in lower income brackets.

In this economy, prioritizing livability over return on investment may seem like an irrational approach, but people today are looking at their homes as a long-term sanctuary, not a quick flip. This new rationale is also reflected in homeowners? approach to financing. ?When asked if they are planning to take a line of credit to fund their remodeling projects, 70 percent of today?s homeowners say ?no way.?

They?d rather cut back elsewhere or do some of the work themselves.

The study also found that 68% of homeowners get their primary ideas and advice online when it comes to home design. Visual and social tools are empowering them to better communicate their vision for their home to everyone involved in the process, from their real estate agent to their architect, designer or builder.

These trends ? a long-term outlook and reliance on information found online ? explain why real estate professionals are turning to visual technologies and tools like Houzz to show clients the potential or vision for a home. Most people simply can?t imagine a home transformation, and need pictures to help them understand.

In fact, at Real Estate Connect last month, the Inman team presented their research on the ?Agent of Tomorrow,? noting that across the board agents surveyed expressed a desire for digital communication and technical tools, and that the agents grossing the most income were already doing business that way.

Realtors in particular are using Houzz ideabooks, which are essentially online folders of photos and notes, as a CRM tool for existing and prospective clients. As one realtor noted, ?If a clients tells me she?s pregnant, I create an ideabook on Houzz of nurseries. If a client is downsizing from the suburbs to the city, I create an ideabook to show him ideas for how to create a home office in a small space.?

How are your clients designing their dream home?

Mitigate Business Disruptions With Comprehensive Business ...

Unanticipated business interruptions can be a huge hindrance in getting an employee to work. These interruptions can range from technical glitches, to network outages, to minor events like sick days or even extreme events like natural disasters. With an efficient business continuity plan, an enterprise can resumes normal operations with none or little delay. The importance of Business Continuity Planning is something that almost every organization has been forced to deal with and the ability of an organization to recover from a disaster is directly related to the degree of Business Continuity Planning that has taken place prior to the occurrence of the disaster.

Organizations must plan for the recovery of key business functions, using priorities and timescales derived from assessed risks and accompanying data. With business continuity planning becoming an imperative in today?s businesses, it is important to invest in an enterprise-class remote desktop access solution that leverages proven technology that is simple, scalable and secure. It has become imperative for regulatory compliance and government mandates to ensure that companies to have secure, auditable access to critical information, even during unforeseen events. Efficiency and productivity is maintained despite any emergency or unforeseen circumstances in businesses with advanced remote desktop access technology. Keeping servers, applications and databases up and running if the employees cannot access them, are of no use.

RDP remote access must be available when the office is no longer functional and the server infrastructure has been moved elsewhere. RDP solutions allow the employee to log in using their daily credentials, just as they do every day at the office and are presented with their desktop icons exactly as they set them up, to their own personal liking. As a result, they benefit from the familiarity of their office computer?s desktop environment ? as if they were actually sitting at their desks and typing and clicking on their office computer.

Add Word Winder to Your Collection of Family-Friendly Board Games

Post image for Add Word Winder to Your Collection of Family-Friendly Board Games

If you?re a Scrabble fan, Word Winder is definitely worth adding to your board game collection. The game challenges you to find words on a grid, much like in a pen and paper word search puzzle. You win by creating a continuous unbroken line of words from one end of the board to the other.

I like that the cards have letters on both sides and can be combined in a bunch of different ways so that the game board is always new. This makes Word Winder a good choice if you are looking for a board game with a lot of replay value.

There are three different colors of chips in the Word Winder set. This works out well for my family of three, but you will need to form teams if you have a bigger group that wants to play.

My son is almost eight, so he?s realistically a little young for word games. He understood the basic concept of this game, but had trouble being able to spell some of the words he wanted to make. I do think it was easier for him to play than Scrabble, however, because there wasn?t the concern about adding up points and getting double or triple letter scores.

For me, the hardest part of the game was getting used to spelling words diagonally. In Word Winder, words may be spelled in any direction as long as the square of each letter in the word is touching the square of the word?s next letter. You can even switch directions in the middle of the word, although this is likely to confuse younger children.

Overall, I?d say Word Winder is a worthy addition to your collection of family-friendly games even if you need to modify the game somewhat for to make it easier for younger players.

You can learn more about Word Winder by visiting the game?s website.

Egypt's call for 'ethical duty' in Syria

The Middle East is truly a new place when an elected Muslim leader of Egypt speaks out in Iran on the need for the world to help free Syria. Such moral stands can have real results.

By the Monitor's Editorial Board / August 30, 2012

Can moral force change world events? When it comes to ending the massacres in Syria and liberating its people, one would hope so.

'; } else if (google_ads.length > 1) { ad_unit += ''; } } document.getElementById("ad_unit").innerHTML += ad_unit; google_adnum += google_ads.length; return; } var google_adnum = 0; google_ad_client = "pub-6743622525202572"; google_ad_output = 'js'; google_max_num_ads = '1'; google_feedback = "on"; google_ad_type = "text"; google_adtest = "on"; google_image_size = '230x105'; google_skip = '0'; // -->

A sign of that force playing out for Syria came Thursday in a startling moment. The newly elected leader of Egypt, Mohammed Morsi, spoke of the world?s ?ethical duty? to side with the Syrian people against an oppressive regime. His were not idle words.

Mr. Morsi, a former member of the Muslim Brotherhood, was speaking at the meeting of the ?nonaligned? nations ? many of whom are ruled by dictators ? in Iran, which is also ruled by a de facto dictatorship. As the prime backer of Syrian dictator Bashar al-Assad, Iran?s clerical autocrats could not help but note that the leader of Egypt, which was liberated last year, was asserting the moral momentum toward democracy in the region.

?Our hearts are bleeding for the Syrian crisis,? Morsi said. ?We have to be totally aware that this bloodshed will not stop if we do not actively intervene.?

He was not alone in challenging the Non-Aligned Movement and others to act. India?s prime minister, Manmohan Singh, asked the assembly body of leaders to take a stand on Syria based on ?universally accepted principles.?

And last week, the new French president, Fran?ois Hollande, spoke of the massacres of women and children in Syria as ?unbearable for the conscience of humanity.? He also took a courageous step by saying France would officially recognize a provisional government of Syrian opposition leaders ?once it is formed.?

The French offer was a helpful nudge for the democratic opposition to unite. Egypt has tried to bring the various factions together. And the United States is training opposition leaders how to run a local government in areas of Syria they now control.

As more world leaders speak out in moral terms about Syria, it will help silence the lies by Mr. Assad and his supporters. Iran, for example, claims that terrorists backed by the US are behind the rebellion. Russia and China, too, find it difficult to explain events in Syria as anything other than a mass movement for freedom.

Egypt and Turkey now stand as the prime moral agents in the region for ending Syria?s civil war and putting together a transitional government. The two nations, ruled by elected Muslim leaders, must set aside any historical rivalry for strategic influence and help create a Syrian democracy.

The Egyptian president has some clout to persuade the United Nations Security Council to act in ousting Assad. Turkey is already seeking UN help in setting up a ?no-fly zone? in Syria to safeguard the tens of thousands of refugees fleeing the violence.

With more than 20,000 Syrians killed over 18 months in this pro-democracy rebellion, leaders like Morsi are compelled to translate moral concern into action. Taking his message to Iran took courage. But seeing what freedom has done so far for Egypt, he can?t help but seek the same for Syrians.

Tips And Strategies Associated To Internet Marketing | Make Money ...

Tips And Strategies Associated To Internet Marketing

You have to have a good Internet marketing system in place if you hope to have a successful business. If you?re not using it already, it?s time to get on board! Marketing can mean the difference between profit or failure of your business. Find your way to Internet marketing success with the ideas in the article below.

Craft your banner ads so that they stand out from the other million banner ads on the web. The more appealing and original your banner ad appears, the more people you?ll have clicking on it.

Use AJAX and Flash sparingly. Although it can help appearances on your site, it has no positive impact when it comes to increasing your search engine results. Flash should be used liberally, and additional keywords and links should be more prominent.

Increase site traffic with original content. This is even more important if your business sells the same goods as many other sites, especially if you all use identical product descriptions from the manufacturer. Write unique product descriptions incorporating keywords to make your site stand out.

If you want to improve your Internet marketing, you need to focus a lot on your emails. Remember to choose a secure e-mail service. Retaining old emails and email addresses can have a huge impact on your business, so don?t use an email service that will delete old messages. Try creating archiving arrangements for emails, particularly if you have sensitive communication with consultants and customers through email.

An FAQ page is a great way to familiarize people with your products. Offer an answer to each question, and mention products you offer as a solution to the problem when it is appropriate. Try to write in a relaxed manner, and mention your products without seeming to force them on your reader.

A successful Internet angle to follow would be to make offers to your customers for added discounts if they happen to spend over a stated amount of money. You can offer them fifteen percent off if they spend over $100. This is a motivator so people purchase more products.

A number of emotional descriptions should be included in your advertising that encourage people to become attached to your product. It will help you to become a recognized brand. Good words to use in your product descriptions include, security, energize, empower, reclaim, etc.

The advertisement of your product should always be positive and inspiring. Clearly explain how your product will help customers improve their lives or reach their goals. You want your customer to be enthusiastic about what your product can do for them, so create a level of hype that they will want to buy into.

A mailing list of your clients is essential. Give your clients the opportunity to opt-in to signing up with a subscribe link or making their email address part of the ordering process. This address can be then used for either sales letters, promotions or seeking feedback on their recent purchasing experience.

Get feedback at every stage. This is important because if you have one view of your website and your customers have a different view, your website will not be successful. Get feedback from customers, relatives and even your competition. Take all of this information under advisement and make any necessary changes.

You can use your cell phone as a work phone too, just ask your cell carrier if they can give you another number that will route to your cell phone. Be certain to acquire a dedicated phone number.

Post new content to your site every week if possible. Visitors who arrive at a site and find that the latest information available was posted months or even years ago are going to draw the wrong conclusions about your business?s current state of affairs. A site that is up-to-date and running well is inviting and encouraging for readers.

With the way the Internet operates in this modern age, you better believe that you need to employ some marketing tactics if you want to compete. You simply cannot afford NOT to use this method of advertising. If you use these tips, you will make sure your business is seen and used on the internet. This will help you succeed with any of your online endeavors

FX orders 90 more episodes of 'Anger Management'

LOS ANGELES (AP) ? FX is ordering 90 more episodes of "Anger Management," Charlie Sheen's TV comeback vehicle after being fired from "Two and a Half Men."

The unusually large order reflects the original agreement that FX made for the sitcom that stars Sheen as a therapist.

As part of the deal, FX set a ratings target for eight of the first 10 episodes of "Anger Management." The show reached the threshold, earning an automatic 90-episode order, the channel said.

The round figure of 100 episodes is the benchmark for series syndication, and that's the future for episodes that have shown first on FX, said producer Debmar-Mercury, a Lionsgate subsidiary.

"Anger Management" will go into syndication in September 2014, the company said Wednesday. It's a model that Debmar-Mercury used with the Ice Cube sitcom "Are We There Yet?" and on "Tyler Perry's House of Payne" and "Meet the Browns."

FX Networks executive vice president Chuck Saftler said he's confident the producers and cast will be able to produce the full order during the next two years after quickly turning out the first 10.

In July, Sheen said the prospect of continuing is as "exciting as hell," and added, "I don't think 90's gonna be enough."

FX called "Anger Management" cable's highest-rated new comedy series this year, averaging 4.5 million total viewers.

The number reflects the show's initial strong showing after its June debut, when it attracted more than 5.5 million viewers.

The show's viewership dropped to below 3 million for some later episodes and was hard-hit by the Olympics in August, averaging just under 2 million, according to Nielsen Co.

But "Anger Management" remained a healthy performer among advertiser-coveted young adult viewers, which was key to FX's decision to place the big-ticket order.

Sheen, who was replaced by Ashton Kutcher on CBS' top-rated comedy, was fired in 2011 by studio Warner Bros. Television because of his erratic personal life and public ridicule of the show's producer.

With "Anger Management," Sheen answers in part to himself with what FX has called a "significant ownership stake" in the show. Bruce Helford is the executive producer.

Antibiotic residues in sausage meat may promote pathogen survival

Tuesday, August 28, 2012

Antibiotic residues in uncured pepperoni or salami meat are potent enough to weaken helpful bacteria that processors add to acidify the sausage to make it safe for consumption, according to a study to be published in mBio?, the online open-access journal of the American Society for Microbiology, on August 28.

Sausage manufacturers commonly inoculate sausage meat with lactic-acid-producing bacteria in an effort to control the fermentation process so that the final product is acidic enough to kill pathogens that might have existed in the raw meat. By killing the bacteria that produce lactic acid, antibiotic residues can allow pathogenic bacteria to proliferate.

Researchers at the University of Copenhagen, Denmark, and University College Cork, Ireland, found that antibiotic concentrations within limits set by US and European Union (EU) regulators are high enough to slow fermentation, the process that acidifies the sausages and helps destroy foodborne pathogens like Salmonella or E. coli.

"At low concentrations and at regulatory levels set by authorities, we could see that the lactic acid bacteria are more susceptible to the antibiotics than the pathogens are," says Hanne Ingmer, of the University of Copenhagen, a researcher on the study. "So basically, we can have a situation where residual antibiotics in the meat can prevent or reduce fermentation by the lactic acid bacteria, but these concentrations do not effect survival or even multiplication of pathogens."

Antibiotics used as growth promoters or to treat disease in livestock can eventually end up in meat, and regulators in the US and EU have set limits on the concentrations of antibiotics in meat for consumption by humans. Ingmer and her colleagues set out to determine whether antibiotics falling within statutory limits might interfere with the process of fermentation in products like pepperoni, salami, or chorizo - sausages that are fermented using lactic- acid-producing bacteria in a curing process many cultures have employed for hundreds of years. She says fermented sausages occasionally cause serious bacterial infections, but it's never been understood why that might be.

In small-scale experiments in the lab, Ingmer and her colleagues added the antibiotics oxytetracycline or erythromycin to meat inoculated with lactic-acid-producing bacteria and pathogens Escherichia coli O157:H7 and Salmonella enterica. They followed the progress of the fermentation and tracked the survival of the pathogens. Ingmer says several different starter cultures of lactic-acid-producing bacteria were sensitive to these antibiotics and hence did not acidify the sausage meat effectively - results that could explain why people sometimes get sick from eating fermented sausage.

Ingmer says the results show antibiotics can potentially have a paradoxical effect that would increase the risk of foodborne illness: antibiotic residues reduce the effectiveness of bacteria that should make the sausages safe but don't affect the bacteria that can cause illness.

Although the results raise an alarm for the manufacture of processed meats, Ingmer stresses that it is important to conduct similar tests in manufacturing facilities. "The majority of sausages are manufactured at a commercial scale. It has to be addressed whether this is a problem in a real life facility," Ingmer says.

Manufacturers with good quality control systems can catch problems in fermentation, Ingmer says, preventing large-scale outbreaks of foodborne illness by testing the final product before it's distributed, but random batch testing could well miss a batch that didn't ferment properly, putting the public at risk.

How can we be sure antibiotic residues don't interfere with the safety of these products? Ingmer sees two possible solutions. If antibiotics are present in meat, boosting the survival and activity of the lactic-acid-producing bacteria is important. In the future, Ingmer hopes to work with manufacturers to develop cultures of lactic-acid-producing bacteria that tolerate low levels of antibiotics.

But the ultimate solution to the problem of antibiotics in meat may be harder to achieve. "The obvious solution is to eliminate the use of antibiotics as growth promoters and closely monitor the use of antibiotics in treating farm animal diseases," Ingmer says. The European Union and other countries have banned the use of antibiotics in livestock as growth promoters, Ingmer points out, a move the US is unlikely to follow very soon.

AP source: '14 MLB All-Star game goes to Minnesota

MINNEAPOLIS (AP) ? The Minnesota Twins will host the 2014 All-Star game at Target Field.

A person with knowledge of the decision, speaking to The Associated Press on condition of anonymity because neither the Twins nor Major League Baseball had announced it, confirmed the news on Tuesday. The decision was first reported by the Star Tribune.

The Twins scheduled a news conference for Wednesday afternoon to make an unspecified "major announcement regarding an upcoming event to be hosted at Target Field," which opened in 2010. The award of MLB's 2014 midsummer showcase to Minnesota has been widely expected for years. Commissioner Bud Selig has all but declared it several times previously.

The 2013 All-Star game is set for Citi Field, home of the New York Mets. The Kansas City Royals hosted this year's game at Kauffman Stadium.

Minnesota last hosted the All-Star game in 1985 at the Hubert H. Humphrey Metrodome, where the Twins played for 28 seasons before moving into their open-air, limestone-and-glass ballpark on the other side of downtown Minneapolis. They've sold an average of 35,202 tickets per game this year despite the worst record in the American League. The Twins lost 99 games last season, too, but drew more than 3.1 million fans.

Tampa Bay, an expansion team in 1998, is the only AL team that hasn't hosted an All-Star game. Other than the Rays, the Twins had the longest current wait in the AL for the game. The Oakland Athletics are next, having hosted the game in 1987.

Miami and Washington, D.C., are the leading contenders for the 2015 game. Because home-field advantage for the World Series goes to the All-Star winner, Selig has said he's reluctant to interrupt alternating All-Star sites between the leagues.

The Minnesota Wild hosted the NHL All-Star game at Xcel Energy Center in 2004, and the Minnesota Timberwolves were the home team for the NBA All-Star game at Target Center in 1994.

Microsoft's Gutierrez safeguards patents | Kuwait Times

tech2 Microsofts Gutierrez safeguards patents

Horacio Gutierrez, pictured May 14, 2012, Microsoft?s deputy counsel of intellectual property, is known for his legal acumen as well as his good humor. ?MCT

SEATTLE: Forget that his face adorns lunchboxes. Darth Vader is supposed to be menacing. But when Horacio Gutierrez, Microsoft?s deputy counsel of intellectual property and licensing, dressed up as the ominous Star Wars Sith Lord one Halloween? Not so much. ?I?ve never seen a happier Darth Vader,? said Gutierrez?s boss, Microsoft general counsel Brad Smith. In some ways that image captures perceptions of Microsoft in the patent battles now raging among tech companies ? and Gutierrez?s role in them.

Microsoft has signed a number of licensing agreements with ? or filed lawsuits against ? companies it says infringe on its patents, most notably manufacturers of devices using Google?s Android operating system. To some, Microsoft is a menace that wields its power to extract sizable royalty payments on Android devices even as its own Windows mobile devices flounder. In that view, Microsoft uses patents as a cash cow rather than a way to protect inventions. To others, Microsoft leads the way in how intellectual-property disputes should be settled, with a preference for licensing over litigation and an eye toward fair settlements ? while protecting its vast investment in research and development over the years. Gutierrez, too, embodies those dual perceptions.

In his role heading the company?s patent, trademark and copyright work, the 47-year-old attorney is in a position to stare down some of the largest technology companies in the world. The work he and his team produce makes headlines, from broad agreements with Samsung to battles with Motorola in courtrooms worldwide. The consequences can be sweeping, from billion-dollar deals to import bans on products. But within Microsoft, Gutierrez is known as much for his good humor as for his legal acumen.

The patent arena is ?filled with conflict, disagreements and complicated technologies. A little humor goes a long way,? said David Kaefer, general manager of intellectual-property licensing, who works for Gutierrez.
The kind of role Gutierrez plays is becoming increasingly visible as high-profile tech companies wage patent battles in courts worldwide over products used daily by millions of people. At Microsoft, Gutierrez leads the team devising strategies on which patents to acquire, what to do with the ones it has, and how to protect its new technologies. He also leads some of the negotiations for licensing deals himself ? including a major 2011 deal with Samsung.

Gutierrez says he thrives on tense negotiations, seeing it as a challenge to break through with humor, empathy and attempts ?to think of ways in which the interests of both companies can be aligned.? ?He?s just creative in finding ways to get the deals done,? said Terry Myerson, head of Microsoft?s Windows Phone division. ?Licensing intellectual property ? doing it in a reasonable but win-win manner -requires incredible creativity and understanding of tech and global intellectual property.? When the Kinect ? Microsoft?s motion- and voice-sensing technology ? was being developed, Gutierrez immediately saw the opportunities for the company, recalled Rich Wallis, deputy general counsel of Microsoft?s interactive entertainment division.

?I remember being in meetings with him where he was so excited about the technology,? Wallis said. ?It was visibly palpable. He?s a high-energy person. His voice gets a little quicker. His eyes light up. The hands start moving.? Gutierrez showed such gusto and ambition from early on. Born and raised in Maracaibo, Venezuela, the son of an attorney father and a homemaker mother, Gutierrez started law school at 16, graduated by 21, and became a partner at a law firm in Venezuela by 28.

He spent a year as a Fulbright Scholar at Harvard University, earning a master?s of law degree, then came to the U.S., working at an investment bank before joining a law firm in Miami and earned his doctor of laws degree from the University of Miami at the same time. ?We quickly realized we had a major talent here,? said Terrence Connor, former managing partner of Morgan, Lewis & Bockius, the law firm where Gutierrez worked in Miami. Gutierrez came to work in Microsoft?s Fort Lauderdale, Fla., office in 1998 after one of his law-journal articles ? on the liabilities of manufacturers for the Y2K bug -caught someone?s eye at Microsoft. He first met Smith, his current boss, during one of Smith?s periodic visits to the company?s regional offices.

Over his two-day visit, Smith focused on anti-piracy issues, leaving little time to talk about commercial concerns ? Gutierrez?s area. ?I was so, so mad,? Gutierrez recalls. ?We had literally two hours to talk and I packed a day of content into those two hours. It was possibly a passive-aggressive thing: ?See what you?ve missed by not focusing on this.? ? Smith recalls that Gutierrez ?just jumped off the page. He easily exceeded my expectations.?

A year and a half later, Smith asked Gutierrez to move to Redmond, where he dealt with European Union and US Department of Justice antitrust investigations of Microsoft. After that, he spent four years in Brussels heading up Microsoft?s legal department for Europe, the Middle East and Africa. In 2006, Gutierrez took over as head of Microsoft?s worldwide intellectual-property group. At the time, the company had ?the desire to go out and do some actual deals and (get) paid for our patents,? Gutierrez said. ?I saw it as my mission to conceive of a licensing program as a way of getting deals done.? These days, Gutierrez lives in Clyde Hill, Wash., with his family ? wife Morella Troconis, a mechanical engineer with an MBA who is currently a homemaker, and three children ages 8 to 18.

All three play soccer, which delights Gutierrez, a big fan. Gutierrez has also turned more attention recently to diversity issues, serving as recently elected president of the Northwest region of the Hispanic National Bar Association and, as part of his position at Microsoft, creating a network for women working in intellectual property. To date, Microsoft has reached more than a thousand agreements in which companies either pay Microsoft royalties or have cross-licensing agreements in which each company uses the other?s patented technologies. One company notably absent from that list: Motorola, now owned by Google. Representatives of Motorola and Google declined to comment for this report. But Google has contended elsewhere that Microsoft, having failed to succeed in the smartphone market, is turning to legal wrangling over patents to ?extort profit from others? achievements and hinder the pace of innovation.?

Microsoft has also taken flak in years past after pursuing companies using the open-source Linux operating system, which includes technologies Microsoft said infringes on its patents. Critics slammed the software giant, seeing it as a moral issue of Microsoft trying to stifle open-source development. Gutierrez, naturally, did not see it that way. ?I grappled with (that) perception,? he said. ?I didn?t think there was an actual issue at all. The companies taking advantage of us were commercial companies making money.? That same outlook applies to the company?s patent battles with manufacturers using Android. ?You can?t infringe on another company?s IP and give that away,? Gutierrez said. ?The solution is licensing.?

Currently, more than 70 percent of all US Android devices are licensed under Microsoft?s program. Gutierrez, a history buff, contends what?s happening now with patent battles in the mobile business is what happens every time there?s been a technological disruption: with the sewing machine, the telegraph and the telephone, for instance. ?What happened eventually was that litigation ran its course. Licensing programs took place or, eventually, technology evolved,? he said. Joff Wild, editor of Intellectual Asset Management Magazine, says that in terms of intellectual property, ?I think Microsoft is probably playing the smartphone wars far more intelligently than any other company.? All tech companies try to manage their intellectual property strategically, Wild said. ?I like the Microsoft strategy best because it?s not driven by emotion; it?s driven by business object.? ? MCT

Refinery blast kills 26 in Venezuela, dozens hurt

CARACAS, Venezuela (AP) ? A huge explosion rocked Venezuela's biggest oil refinery and unleashed a ferocious fire on Saturday, killing at least 26 people and injuring more than 80 others in one of the deadliest disasters ever to hit the country's key oil industry.

Balls of fire rose over the Amuay refinery, among the largest in the world, in video posted on the Internet by people who were nearby at the time. Government officials pledged to restart the refinery within two days and said the country has plenty of fuel supplies on hand to meet its domestic needs as well as its export commitments.

The explosion shattered walls of nearby shops, ripped out windows from homes and left the surrounding streets covered with rubble and twisted scraps of metal.

President Hugo Chavez declared three days of mourning and ordered an investigation to determine the cause of the explosion. "This affects all of us," Chavez said by phone on state television. "It's very sad, very painful."

In a neighborhood next to the refinery, shopkeeper Yolimar Romero said she was at her computer when a shock wave swept over the area shortly after 1 a.m.

"At that instant, the whole house shook as if it were an earthquake," she said. "The windows went flying off with their frames and everything."

Electricity was knocked out, leaving Romero in the dark and her house filled with smoke. She found a flashlight and started looking for her husband and three children.

Outside on the street, the family saw scattered hunks of brick walls and ruins of a National Guard post and about 20 other homes. Bodies were being pulled from buildings down the street.

At least 86 people were injured, nine of them seriously, Health Minister Eugenia Sader said at a hospital where the wounded were taken. She said 77 people suffered light injuries and were released.

Officials said those killed included a 10-year-old boy, and that 17 of the 26 victims were National Guard troops stationed at the post next to the refinery.

Vice President Elias Jaua, who traveled to the area in western Venezuela, said the authorities tried "to save the greatest number of lives."

Officials said firefighters had largely controlled the fire at the refinery on the Paraguana Peninsula, where flames were still visible on Saturday night after billowing dark smoke all day.

The blast occurred about 1:15 a.m. when a natural gas leak created a cloud that ignited, Oil Minister Rafael Ramirez said.

"That gas generated a cloud that later exploded and has caused fires in at least two tanks of the refinery and surrounding areas," Ramirez said.

Images shortly after the explosion showed the flames casting an orange glow against the night sky, and injured survivors on a stretcher and in a wheelchair. The bloodied bodies of victims were loaded onto pickup trucks.

Ramirez said a panel of investigators was being formed to determine the cause of the gas leak. A prosecutor was appointed to lead the investigation and troops were deployed to the area.

While the cause of the disaster remains unclear, some oil workers and critics of Chavez's government have recently pointed to increasing numbers of smaller accidents and spills as an indication of problems within the state-run company.

"We warned that something was going to happen, a catastrophic event," said Ivan Freites, secretary general of a 1,200-member union of oil and natural gas industry workers in Falcon state where the refinery is located. He spoke in a telephone interview from an area near the refinery, where he could see the flames raging in the distance.

The refinery complex's general manager, Jesus Luongo, denied that a lack of maintenance was to blame, saying in the past three years more than $6 billion has been invested in maintaining the country's refineries.

Ramirez said the explosion hit an area of storage tanks, damaging nine tanks.

"All of the events happened very quickly," Ramirez said. "When we got here in the middle of the night, at 3 or 3:30 in the morning, the fire was at its peak."

The oil minister said that supplies of fuel had been cut off to part of the refinery and that firefighters were using foam to extinguish the flames in one of the remaining tanks.

"This regrettable and sad event is controlled, is under control," Ramirez said on television, while plumes of smoke continued to billow.

Amuay is part of the Paraguana Refinery Complex, which also includes the adjacent Cardon refinery. Together, the two refineries process about 900,000 barrels of crude per day and 200,000 barrels of gasoline. Venezuela is a major supplier of oil to the U.S. and a member of the Organization of Petroleum Exporting Countries.

Ramirez said the state oil company Petroleos de Venezuela SA should be able to "restart operations in a maximum of two days."

"We want to tell the country that we have sufficient inventories of fuel. We have 10 days of inventory of fuel," Ramirez said. He said the country's other refineries were operating at full capacity and would be able to "deal with any situation in our domestic market."

An official of the state oil company, known as PDVSA, said the country also has enough supplies on hand to guarantee its international supply commitments. The official spoke on condition of anonymity because he wasn't authorized to speak publicly about the matter.

In terms of international oil markets, the disaster is not likely to cause much of a ripple, said Jason Schenker, an energy analyst and president of Austin, Texas-based Prestige Economics LLC. Noting that other refinery accidents and shutdowns regularly occur around the world, he said: "There's likely to be relatively limited impact on global crude or product pricing."

"The real tragedy," he said, "is that these events continue to happen, not just in Venezuela but everywhere. It is a dangerous business."

Gustavo Coronel, an energy consultant and former PDVSA executive, called the tragedy "probably the worst one the oil industry has had in many years."

"Accidents happen, of course, although the problem with PDVSA is the inordinate amount of accidents that have taken place during the last years," Coronel said. Considering the overall record, "we are not talking about bad luck but about lack of maintenance and inept management," he said.

The labor leader Freites, who has worked at the refinery for 29 years, said workers had repeatedly alerted state oil company officials to problems that they feared could lead to an accident. "We've been complaining about problems and risks, including fires, broken pipes and a lack of spare parts," Freites said.

One opposition group comprised of former PDVSA employees, Gente del Petroleo, or Oil People, said it could not yet pass judgment on the cause of the explosion. But it but noted there had been ample concerns about lack of maintenance and poor management.

The group said in a statement that since 2003, 79 other serious accidents have been reported at the Paraguana Refinery Complex, collectively killing a total of 19 workers and injuring 67 others.

Opposition leader Henrique Capriles, who is challenging Chavez in the country's Oct. 7 presidential election, expressed condolences to the victims and their families.

"We Venezuelans are one, and we grow in the face of this type of situations," Capriles said.

South Florida on hurricane alert as Isaac exits Haiti

The tropical storm is expected to continue traveling northwest, and after emerging north of Cuba it is likely to impact the Gulf Coast. Weather Channel meteorologist Jim Cantore reports wind off the coast of South Florida's Biscayne Bay could cause flooding.

By NBC News and wire services

PORT-AU-PRINCE, Haiti -- At least two people died in Haiti as Tropical Storm Isaac triggered mudslides and flooding there before heading back over water and towards Cuba. Isaac should become a hurricane on Sunday just as it nears the Florida Keys, the U.S. National Hurricane Center said.

"Hurricane conditions are expected in the hurricane warning area in southwest Florida and the Florida Keys on Sunday," the center said in a Saturday morning advisory.

In Haiti,??a woman and a child in the town of Souvenance were killed in the storm, a local official reported.

The capital Port-au-Prince, where some 350,000 people are still living in tents or shelters after the 2010 Haiti earthquake, was faring better. While heavy rain pushed rocks and mud into tent cities, no deaths or major damage were reported.

Cuba prepared by closing beaches and evacuating tourists in vulnerable areas, NBC's Mary Murray and The Weather Channel's Mike Seidel reported from Havana. Flights across Cuba were also suspended.?

In Baracoa, a city on Cuba's eastern side, high seas began topping the seawall Friday night, Radio Baracoa reported.?

Now with 60 mph winds, Isaac should exit Cuba on Sunday as a Category 1 hurricane and then move south of the Florida Keys and into the Gulf.

Those considered most vulnerable were urged to move into an evacuation camp housed in a school building, but others with nowhere else to go were digging trenches to avoid the water. Haiti's population remains especially vulnerable due to the country's sprawling shanty towns. NBC's Mark Potter reports.

Republicans are preparing to gather in Tampa, on Florida's central Gulf Coast, for Monday's start of their national convention ahead of the November presidential election.

The convention is expected to proceed as planned but Gulf of Mexico operators began shutting down offshore oil and gas rigs on Friday ahead of the storm.?

Tampa's weather forecast includes rain and high winds Sunday night and into Monday, The Weather Channel reported. The winds could gust up to 60 mph.

Monday and Tuesday include a risk of tornadoes across south Florida.?

Isaac's exact path is still unclear, but the hurricane center said models suggest it will make landfall somewhere?between the Florida Panhandle and New Orleans.

The storm's anticipated path did shift closer to the Keys than previously forecast and emergency managers urged tourists to leave the islands if they could do so safely. A single road links the chain of islands to the Florida Peninsula.?

bearing blog: Postsecondary education questions: Can you still work ...

More fact-gathering. ?Just this past spring, PBS Newshour's blog The Rundown posted a useful article:

In researching the growing amount of college loan debt that students are taking on as academic sticker prices steadily increase, we wondered: Is it possible to pay for college through summer and part-time jobs alone?

So we compiled data from the Bureau of Labor Statistics, the National Center for Education Statistics and others to create a calculator that compares possible annual income vs. college expenses since 1976, the first year all the data we need is available.

You can plug in your own hourly income as well as hours worked over the school year and during summer, and whether you attend a private or public college for a two-year or four-year program. Or, you can use our assumptions of the federal minimum wage rate -- currently $7.25 an hour -- with a part time job of 20 hours per week during the school year and a full-time job of 40 hours per week over the summer. Mousing over the lines shows you the college costs for that year and earnings. The difference shows whether you've made enough money or if you need more to foot the bill.

The calculator is located here.

Looking at four-year public institutions and using our assumptions for hours worked and income, average college costs actually could have been paid for up until the 2000-2001 school year. After that, a student would have to work more hours, or make more per hour, to keep up.

I think they must have changed the calculations since they wrote the article, because when I put "minimum wage," "four-year" and "public" into the calculator, I see the lines cross in 1991-92 --- my senior year in high school. ?

(Having played with the numbers, I suspect they erred and got the "could have been paid for up to 2000-2001" for the case of "working 40 hours a week all year long while attending school full time.")

It is extremely instructive to look at the average costs of two-year?public colleges. ?In 2012, you can just about break even working a minimum-wage job for only 15 hours a week during the school year, and 40 hours a week during the summer. ?

If you are attending a four-year college, you can just about break even working the same amount of hours if you could get your hourly wage up to $13.50. ?Perhaps this is a good argument for doing some time in a vocational or trade school before?starting college -- anything to bump your earnings significantly above minimum wage.

There's always the work a little, study a little option. ?What if you worked minimum wage, 40 h/week for a year (saving ALL your money), then attended school with room and board for a school year, for eight years in a row, working all the summers? ?I calculate that if you'd done that for the past eight years, you'd actually have come out ahead by $9500 to put toward your other expenses. ?

Those two-year colleges are looking like a better and better idea.

Spend some time with the calculator and tell me what you've learned.

ScienceDaily (Aug. 23, 2012) ? Humans inherit more than three times as many mutations from their fathers as from their mothers, and mutation rates increase with the father's age but not the mother's, researchers have found in the largest study of human genetic mutations to date.

The study, based on the DNA of around 85,000 Icelanders, also calculates the rate of human mutation at high resolution, providing estimates of when human ancestors diverged from nonhuman primates. It is one of two papers published this week by the journal Nature Genetics as well as one published at Nature that shed dramatic new light on human evolution.

"Most mutations come from dad," said David Reich, professor of genetics at Harvard Medical School and a co-leader of the study. In addition to finding 3.3 paternal germline mutations for each maternal mutation, the study also found that the mutation rate in fathers doubles from age 20 to 58 but that there is no association with age in mothers -- a finding that may shed light on conditions, such as autism, that correlate with the father's age.

The study's first author is James Sun, a graduate student in Reich's lab who worked with researchers from deCODE Genetics, a biopharma company based in Reykjavik, Iceland, to analyze about 2,500 short sequences of DNA taken from 85,289 Icelanders in 24,832 father-mother-child trios. The sequences, called microsatellites, vary in the number of times that they repeat, and are known to mutate at a higher rate than average places in the genome.

Reich's team identified 2,058 mutational changes, yielding a rate of mutation that suggests human and chimpanzee ancestral populations diverged between 3.7 million and 6.6 million years ago.

A second team, also based at deCODE Genetics (but not involving HMS researchers), published a paper this week in Nature on a large-scale direct estimate of the rate of single nucleotide substitutions in human genomes (a different type of mutation process), and came to largely consistent findings.

The finding complicates theories drawn from the fossil evidence. The upper bound, 6.6 million years, is less than the published date of Sahelanthropus tchadensis, a fossil that has been interpreted to be a human ancestor since the separation of chimpanzees, but is dated to around 7 million years old. The new study suggests that this fossil may be incorrectly interpreted.

Great Heights

A second study led by HMS researchers, also published in Nature Genetics this week, adds to the picture of human evolution, describing a newly observable form of recent genetic adaptation.

The team led by Joel Hirschhorn, Concordia Professor of Pediatrics and professor of genetics at Boston Children's Hospital and HMS, first asked why closely-related populations can have noticeably different average heights. David Reich also contributed to this study.

They examined genome-wide association data and found that average differences in height across Europe are partly due to genetic factors. They then showed that these genetic differences are the result of an evolutionary process that acts on variation in many genes at once. This type of evolution had been proposed to exist but had not previously been detected in humans.

Although recent human evolution is difficult to observe directly, some of its impact can be inferred by studying the human genome. In recent years, genetic studies have uncovered many examples where recent evolution has left a distinctive signature on the human genome. The clearest "footprints" of evolution have been seen in regions of DNA surrounding mutations that occurred fairly recently (typically in the last several thousand years) and confer an advantageous trait, such as resistance to malaria. Hirschhorn's team observed, for the first time in humans, a different signature of recent evolution: widespread small but consistent changes at many different places in the genome, all affecting the same trait, adult height.

"This paper offers the first proof and clear example of a new kind of human evolution for a specific trait," said Hirschhorn, who is also a senior associate member of the Broad Institute. "We provide a demonstration of how humans have been able to adapt rapidly without needing to wait for new mutations to happen, by drawing instead on the existing genetic diversity within the human population."

Average heights can differ between populations, even populations that are genetically very similar, which suggests that human height might have been evolving differently across these populations. Hirschhorn's team studied variants in the genome that are known to have small but consistent effects on height: people inheriting the "tall" version of these variants are known to be slightly taller on average than people inheriting the "short" versions of the same variants.

The researchers discovered that, in northern Europe, the "tall" versions of these variants are consistently a little more common than they are in southern Europe. The combined effects of the "tall" versions being more common can partly explain why northern Europeans are on average taller than southern Europeans. The researchers then showed that these slight differences have arisen as a result of evolution acting at many variants, and acting differently in northern than in southern Europe.

"This paper explains -- at least in part -- why some European populations, such as people from Sweden, are taller on average than others, such as people from Italy," Hirschhorn said.

The researchers were only able to detect this signature of evolution by using the results of recent genome-wide association studies by the GIANT consortium, which identified hundreds of different genetic variants that influence height.
